Information we collect
When you submit information as a job seeker or employer — including name, contact details, resume content, and work history — we collect what you provide directly through our forms or in conversation with us.
How we use it
We use candidate information to evaluate fit for open roles and to share relevant candidates with employer clients. We use employer information to understand hiring needs and deliver search or pipeline services.
Who we share it with
Candidate information is shared only with employers actively considering that candidate for a specific role.
Data retention
How long we keep it. We retain job seeker and candidate records — including applications, resumes, and related communications — for one (1) year from the date of last activity on your file (such as your submission date, most recent contact with us, or the hiring decision for the role you applied to). This period reflects the retention standard for employers and employment agencies under Hawaiʻi Administrative Rules § 12-46-21 and the recordkeeping periods set by the U.S. Equal Employment Opportunity Commission under Title VII, the ADA, and the ADEA. If you are placed in a role through HatchPoint, we retain records related to that placement for one (1) year from your placement date, on the same standard. We retain employer client records for the length of our engagement plus one (1) additional year, to preserve records tied to any placement made during that time.
At the end of the applicable period, we securely delete or permanently de-identify your information, unless a longer period is required by law — for example, during a pending EEOC charge, audit, or legal claim — or you have asked us to delete it sooner, as described below.
Requesting deletion. You may ask us to delete your information before the standard retention period ends by emailing accounts@hatchpoint.us with the subject line “Data Deletion Request.” We will confirm your request within 7 business days and complete deletion within 14 business days, except where we are required to keep a record by law. We may ask you to verify your identity first. Note that deleting your information means we can no longer consider you for roles we might otherwise have reached out about.
Your rights
Nondiscrimination. Hawaiʻi's Fair Employment Practices Act (HRS Chapter 378, Part I) and federal law (Title VII, the ADA, the ADEA, and related statutes) prohibit discrimination in hiring based on race, color, ancestry, national origin, religion, sex (including gender identity and pregnancy), sexual orientation, age, disability, marital status, arrest and court record, and other protected categories. If you believe you've experienced discrimination in connection with a search we've run, you may file a complaint with the Hawaiʻi Civil Rights Commission (labor.hawaii.gov/hcrc, (808) 586-8636) within one year of the alleged discriminatory practice, or with the EEOC (Honolulu office, (808) 800-2350), which may extend the filing window under its worksharing agreement with the HCRC.
Correcting your information. You can ask us to correct inaccurate information in your candidate file at any time by emailing accounts@hatchpoint.us. Beyond the specific protections above, Hawaiʻi does not currently have a comprehensive consumer privacy law giving individuals a general right to access or delete personal data held by a private employer or employment agency — the deletion process we offer under Data Retention above is a practice we've chosen to provide, not one required by Hawaiʻi law. If you are located in a state with its own data privacy law, you may have additional rights beyond what's described here; contact us and we'll address your request based on where you're located.
